2. Access to and use of the Presentation Platform
2.1 The personal login credentials may only be used by the Employee personally for using the relevant Presentation Platform. 2.2 Employee undertakes to treat his personal credentials, coupons or order codes as confidential and protect them against improper use. 2.3 In the event of loss of the personal login credentials, Employee shall be given new personal login credentials. 2.4 Employee shall not be entitled to resell the goods and services purchased at a reduced price on a commercial basis on his part, in particular via online auctions or the like. 2.5 In case of any violations against this provision, Employee may be excluded from further use of the Platform. 2.6 Leaving the company the employee makes sure that his account will be deleted.
3. Transactions between Providers and Employees
3.1 The Presentation Platform is a virtual market place in the sense that is only provides the framework for initiating business relationships between the Provider and the Employee who is interested in the offers. 3.2 Any contract relationship between Employee and Provider shall be concluded outside the Presentation Platform and without any third party being directly or indirectly involved, usually either on the Provider’s own website or by sending e-mails or using any other kind of direct communication between Provider and Employee.
4.1 We do not assume any liability for the correctness of the information given and the conduct and performance of the Providers whose goods and services are made available or accessible through the Presentation Platform. We neither assume any liability for the correctness and completeness of the information and presentations made by the Providers, for the actual availability, quality, usability and fitness for a particular purpose of the goods and services nor for the non-infringement of third-party rights. 4.2 We do not guarantee that the discounts are actually being granted by the Providers or that the offers will bring savings for the Employees. 4.3 As any agreement shall only be concluded directly between Employee and the Providers presented on the Presentation Platform, any warranty or other claims may only be asserted between these two parties, i.e. in case of doubt, Employee is required to contact the other party to the contract.
5. Other General Provisions
5.1 As far as the contract is concluded by way of electronic commerce, the specific duties to inform and disclose as well as other duties as required by law in such a case (§ 312e German Civil Code, BGB) shall be deemed to have been fulfilled.
